Terms of Service
Effective October 25, 2026
If the English and Turkish versions of this document differ, the Turkish version prevails.
These Terms of Service ("Terms") govern the use of Targity, a software service for sending SMS, WhatsApp and email messages to the customers of online stores (the "Service"). The Service is provided by Muhammed Yeğenoğlu, trading as Targity, Kartal, İstanbul, Türkiye (tax office: Kartal) ("Targity", "we", "us").
By creating an account or using the Service, the business you represent ("Customer", "you") accepts these Terms, the Acceptable Use Policy and the Data Processing Agreement, which form part of them. The Service is offered to businesses only, not to consumers.
1. The Service
Targity connects to your e-commerce platform, imports the data needed to run your messaging (customers, products, orders, carts, consent records), lets you build segments, templates and automations, sends messages through the channels you connect, and reports their results. Features available to you depend on your plan.
We may improve, change or discontinue features. If a change significantly reduces the paid features you rely on, we will tell you at least 30 days in advance.
2. Your account
- You must give accurate information when signing up and keep it up to date, including your store's website domain.
- You are responsible for everything done under your account and for keeping passwords confidential. Tell us at help@targity.com straight away if you suspect unauthorised access.
- The person accepting these Terms confirms they are authorised to bind the business.
3. Free trial, plans and payment
- New stores get a free trial; one trial is available per website domain. No payment details are needed for the trial.
- When the trial ends you can choose a paid plan. Until you do, sending stops; your data is kept for at least 30 days.
- Paid plans are billed in advance for each monthly or yearly period, at the price shown when you subscribe. Prices are in Turkish lira and exclude VAT unless stated otherwise.
- Message costs charged by third parties (SMS operators, Meta for WhatsApp) are billed by those providers directly to the account you connect, unless agreed otherwise.
- If a payment fails we may suspend the Service after notifying you.
- You can cancel at any time; the Service continues until the end of the paid period. Fees already paid are not refunded, except where the law requires.
4. Your responsibilities as a sender
You are the sender of every message sent through your account, and the controller of your customers' personal data. You must:
- send commercial messages only to people who have given the consent required by law, in particular Law No. 6563 on the Regulation of Electronic Commerce and its regulation on commercial communications, and register consents with the Message Management System (İYS) where required;
- comply with the Personal Data Protection Law No. 6698 (KVKK) and, where applicable, the GDPR, including informing your customers that you use service providers such as Targity;
- honour opt-outs immediately and include the sender identity and opt-out information messages must contain;
- follow the rules of the channels you use (for example SMS sender name approvals and Meta's WhatsApp Business policies);
- follow the Acceptable Use Policy.
Targity provides tools that help with this (consent filters, opt-out links, test mode), but does not check the lawfulness of your messages and is not responsible for their content.
5. Connected services
The Service works with third-party services you connect, such as your e-commerce platform, SMS provider or WhatsApp Business account. Your use of them is governed by your agreements with those providers. We are not responsible for their availability, prices or actions, including restrictions they place on your account.
6. Data
- You own your data. We process your customers' personal data only on your behalf and on your instructions, as set out in the Data Processing Agreement.
- How we handle the personal data of your team and of visitors to our site is described in our Privacy Policy and KVKK Notice.
- We may use aggregated, anonymous statistics (for example delivery rates across all stores) to run and improve the Service.
7. Suspension and termination
We may suspend sending or your account, with notice where reasonable and immediately where needed, if you breach these Terms or the Acceptable Use Policy, if your messages cause high complaint or bounce rates, if a channel provider requires it, or to protect the Service or others. Either party may terminate for a material breach that is not remedied within 15 days of written notice. After termination you can request an export of your data for 30 days; after that we delete it, except where the law requires us to keep it.
8. Availability and support
We aim to keep the Service available at all times but do not guarantee uninterrupted operation. Planned maintenance is announced in advance where possible. Support is provided by email at help@targity.com.
9. Intellectual property
The Service, its software and design belong to Targity. You receive a non-exclusive, non-transferable right to use it during your subscription. Content you upload (templates, images, texts) remains yours; you grant us the rights needed to host and send it for you.
10. Liability
- You will indemnify Targity against claims by third parties, including fines by authorities, arising from messages you send or data you process in breach of the law or these Terms.
- Neither party is liable for indirect or consequential damages such as lost profits, except in cases of intent or gross negligence.
- To the extent permitted by law, Targity's total liability is limited to the fees you paid in the 12 months before the claim.
11. Changes to these Terms
We may update these Terms. We will notify you of material changes by email or in the dashboard at least 15 days before they take effect. Continuing to use the Service after that date means you accept them.
12. Governing law
These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İstanbul Anadolu have jurisdiction. If the English and Turkish versions differ, the Turkish version prevails.
